Michigan's Child Support Amnesty Program

Program Description:
To be eligible for the program the payer must, between October 1, 2005, and December 31, 2005:

- Pay all of his/her past-due support and send or bring the payment with the completed Child Support Amnesty Request Form to the friend of the court.

- Pay half of his/her past-due support and send or bring the payment with the completed Child Support Amnesty Request Form to the friend of the court. The Child Support Amnesty Program requires the payer to pay his/her remaining balance by December 31, 2005.

Payers are not eligible to participate in the Amnesty Program if:
- Felony prosecution for failure to pay child support has been started and the felony matter has not been resolved; or
- The payer is arrested on a bench warrant for failure to pay child support between October 1, 2005, and December 31, 2005.

A payer with multiple support cases must complete a separate Child Support Amnesty Request Form and provide separate amnesty payments for each support case (s)he wishes to include in the Amnesty Program. A payer may participate in the Amnesty Program for one or more of his/her support cases.

The Amnesty Program only applies to past-due support the payer owed as of the date the payer applied for the Amnesty Program. A payer's income withholding orders issued to employers and others will remain active during the Amnesty Program. The friend of the court will withdraw the request to intercept a payer's state tax refund to pay past-due support when the payer successfully completes the Amnesty Program.
